THDV means THDV, registered with the Dutch Chamber of Commerce (KVK) under number 85584290, with its registered address at Postbus 1007, 2200 BA Noordwijk, The Netherlands, and operating the website and webshop through which luxury Products are offered for sale.
Customer means any natural person or legal entity entering into an Agreement with THDV.
Consumer means a Customer acting outside their trade, business or profession.
Product means any item offered by THDV, including pre-owned luxury Products, accessories, Special Items, samples and gifts.
Agreement means the purchase agreement between THDV and the Customer.
Article 2 — Applicability
These Terms & Conditions apply to every offer, order and Agreement concluded between THDV and the Customer.
Before completing an order, the Customer has the opportunity to review these Terms & Conditions and store them for future reference.
By placing an order, the Customer confirms acceptance of these Terms & Conditions.
If any provision conflicts with mandatory consumer protection law, such mandatory legal provisions shall prevail.
Any deviations from these Terms & Conditions are only valid if expressly agreed in writing by THDV.
Article 3 — Products
THDV specialises in carefully selected pre-owned luxury Products.
Every Product is individually inspected and described before being offered for sale.
Product descriptions, photographs, measurements, condition reports and disclosed characteristics form an essential part of the Agreement.
Due to the nature of vintage and pre-owned luxury Products, items may contain signs of previous ownership, wear, ageing or restoration consistent with their history.
Such characteristics do not constitute defects where they have been disclosed or are reasonably expected considering the nature of the Product.
Colours and appearance may differ slightly depending on screen settings, lighting conditions and photography.
Article 4 — Orders & Formation of the Agreement
All Products displayed on the THDV website are subject to availability.
An Agreement is concluded when THDV confirms the Customer's order or when THDV dispatches the Product.
THDV reserves the right to refuse or cancel an order where reasonable grounds exist, including:
- suspected fraud or misuse of payment methods;
- incorrect pricing or technical errors;
- Product availability issues;
- circumstances making fulfilment impossible.
If payment has already been received for an order that cannot be fulfilled, THDV will refund the amount paid.
Article 5 — Prices & Payment
All prices displayed by THDV are stated in euros and include VAT where applicable.
Additional costs, including shipping charges, customs duties, import taxes or local charges, may apply depending on the destination.
Such additional charges are the responsibility of the Customer unless otherwise stated.
Payment must be completed using one of the payment methods provided by THDV before shipment, unless otherwise agreed.
THDV reserves the right to correct obvious pricing errors caused by technical issues or incorrect information.
Article 6 — Shipping
THDV ships worldwide using reliable delivery partners.
Depending on destination, Product value and circumstances, THDV may use insured and traceable shipping methods.
Shipping may be performed through carriers including PostNL, DHL, UPS or another suitable logistics partner.
The Customer is responsible for providing complete and accurate delivery information.
THDV shall not be responsible for delays or additional costs caused by incorrect information supplied by the Customer.
International Customers are responsible for compliance with local import regulations and payment of applicable duties and taxes.
Article 7 — Delivery
THDV will make reasonable efforts to dispatch Products within the estimated timeframe communicated to the Customer.
Delivery times are indicative and may be affected by circumstances outside THDV's reasonable control, including carrier delays, customs procedures or unforeseen events.
A delay in delivery does not automatically entitle the Customer to compensation unless required under mandatory applicable law.
The Customer is responsible for checking the package upon delivery and reporting visible transport damage without undue delay.
Article 8 — Risk & Ownership
For Consumers, the risk of loss or damage transfers upon delivery of the Product to the Customer or a third party designated by the Customer, unless mandatory law provides otherwise.
For Business Customers, the risk transfers upon delivery to the carrier unless otherwise agreed in writing.
The Customer shall handle the Product with appropriate care after delivery.
Article 9 — Retention of Title
Ownership of the Product remains with THDV until full payment of all amounts owed by the Customer has been received.
Until ownership has transferred, the Customer shall not sell, transfer, pledge or otherwise dispose of the Product where such restriction applies under applicable law.
Ownership transfers automatically once THDV has received full payment.
Article 10 — Right of Withdrawal
Consumers have the right to withdraw from the Agreement within fourteen (14) days after receiving the Product, unless a legal exception applies.
The withdrawal period starts on the day after the Consumer or a third party designated by the Consumer receives the Product.
The Customer must inform THDV clearly within the withdrawal period when exercising this right.
The Product must be returned in the same condition as received, including packaging, accessories, authenticity documents and other supplied materials.
The Customer is responsible for any diminished value caused by handling beyond what is necessary to inspect the Product.
Article 11 — Returns
Returns must be shipped using a secure and traceable delivery method.
For high-value Products, THDV strongly recommends insured return shipping.
The Customer remains responsible for the Product until it has been received by THDV.
THDV may reduce or refuse a refund where the Product has been damaged, altered, repaired, worn beyond reasonable inspection or returned incomplete, to the extent permitted by applicable law.
Business Customers do not have a statutory right of withdrawal unless expressly agreed otherwise.
Article 12 — Refunds
Refunds will be processed after THDV has received and inspected the returned Product.
Refunds will be made using the same payment method used by the Customer unless another method has been agreed.
THDV may postpone reimbursement until the Product has been received or until proof of return has been provided.
Where required by mandatory consumer law, original delivery costs will be refunded.
Article 13 — Product Condition & Conformity
THDV carefully describes each Product, including its condition, characteristics, history and any relevant details known at the time of sale.
Due to the nature of pre-owned luxury Products, items may contain signs of previous ownership, wear, ageing, restoration or other characteristics consistent with their history.
Such characteristics do not constitute defects where they have been disclosed in the Product description or are reasonably expected considering the nature of the Product.
The Product description, photographs and disclosures provided by THDV form an essential part of the Agreement.
Article 14 — Warranty
THDV guarantees that Products sold as authentic are genuine unless explicitly disclosed otherwise before purchase.
The warranty does not cover normal wear and tear, age-related characteristics, accidental damage, misuse, improper storage, repairs or modifications made after delivery, to the extent permitted by applicable law.
Where the Customer believes that a Product does not conform to the Agreement, the Customer must notify THDV within a reasonable period after discovering the issue.
Nothing in these Terms & Conditions limits mandatory consumer rights regarding legal conformity requirements.
Article 15 — Authenticity Guarantee
THDV is committed to offering authentic luxury Products. Every Product is carefully reviewed before being offered for sale.
Unless explicitly stated otherwise in the Product description, THDV guarantees that Products sold as authentic are genuine.
THDV uses professional expertise, experience and, where appropriate, recognised external authentication services to evaluate Products.
Authentication may include assessment of materials, craftsmanship, construction, hardware, markings, serial numbers, date codes, microchips and other relevant characteristics.
Due to the nature of vintage luxury Products, authentication may require evaluation of multiple characteristics rather than reliance on a single identifier.
Article 16 — Authentication Services & Certificates
THDV may use independent authentication providers where appropriate.
THDV may offer Customers the possibility to obtain an additional authenticity certificate or authentication report where available.
The availability of such certificate depends on the Product, available authentication methods and whether authentication is technically and commercially possible.
The absence of an authenticity certificate does not automatically indicate that a Product is not authentic.
Certain rare, vintage, limited edition, discontinued or non-standard Products may fall outside standard authentication procedures.
Article 17 — Authenticity Claims
If the Customer has doubts regarding the authenticity of a Product, the Customer must notify THDV in writing without undue delay and in any event no later than thirty (30) days after delivery.
The Customer must provide a clear explanation of the authenticity concern and provide relevant information supporting the claim.
The Customer shall make the Product available for inspection by THDV or an appointed specialist.
The Customer shall not sell, transfer, repair, restore, modify or otherwise alter the Product until the authenticity investigation has been completed.
The Customer acknowledges that timely notification is essential due to the nature of luxury Products and the importance of preserving their original condition.
Article 18 — Authenticity Investigation Procedure
After receiving an authenticity claim, THDV may perform an internal review and request additional information, photographs or documents.
THDV may engage independent specialists or authentication providers where considered appropriate.
The Customer acknowledges that authentication is a professional assessment process which may require reasonable time.
THDV will communicate the outcome after all relevant information has been reviewed.
Article 19 — Third-Party Authentication Decisions
The Customer acknowledges that authentication providers, resale platforms and marketplaces may apply their own standards, procedures and acceptance criteria.
THDV cannot guarantee that any specific third party will authenticate, accept, list or purchase a Product.
A refusal by a third party to authenticate, list or accept a Product does not, by itself, constitute evidence that the Product is counterfeit, non-conforming or not as described.
Third-party standards and policies may change over time and are outside the control of THDV.
Article 20 — Samples, Gifts and Non-Standard Boutique Items
20.1 Nature of the Products
Certain Products offered by THDV, including but not limited to production samples, showroom samples, prototype items, boutique gifts, VIP gifts, promotional items and Chanel gift items (collectively referred to as "Special Items"), differ from Products manufactured for normal retail sale.
These Products may have been created for internal use, promotional purposes, boutique distribution, special events or limited circulation rather than regular retail sale.
As a result, Special Items may not contain all characteristics, packaging, serial numbers, date codes, microchips or other identifiers commonly found on standard retail Products.
Such Products may therefore fall outside the scope of standard authentication methods, databases or authentication services.
20.2 Customer Acknowledgement
Before purchasing a Special Item, THDV will clearly disclose that the Product may not be capable of being authenticated using conventional authentication services or methodologies.
By completing the purchase, the Customer expressly acknowledges and accepts that:
- the Product may not qualify for authentication by certain third-party authentication providers;
- no certificate of authenticity can be issued after purchase where authentication is technically or commercially impossible;
- the purchase price reflects the disclosed characteristics, rarity and limitations of the Product;
- the Customer has received sufficient information and has had the opportunity to ask questions before purchase.
20.3 No Authentication Guarantee
For Special Items, THDV does not guarantee that any independent authentication provider, resale platform, marketplace or third party will be able or willing to authenticate the Product or issue an authenticity certificate.
The inability or refusal of a third party to authenticate such Product shall not, by itself, constitute evidence that the Product is counterfeit, non-conforming or not as described.
20.4 Acceptance of Risk
The Customer acknowledges that purchasing a Special Item involves characteristics and uncertainties that differ from purchasing a standard retail Product.
The Customer accepts these disclosed characteristics as part of the Agreement and acknowledges that these characteristics are reflected in the purchase price.
Nothing in this Article limits mandatory rights that the Customer may have under applicable consumer protection laws.
Article 21 — Product Description Prevails
For Special Items, the Product description, photographs and disclosures provided by THDV before purchase form an essential part of the Agreement.
The Customer confirms that the purchasing decision is based on the Product description, photographs and disclosed characteristics of the Product.
This includes disclosed limitations relating to authentication, packaging, serial numbers, date codes, microchips, identifiers or other Product characteristics.
The Customer acknowledges that the purchase decision is not based solely on the future availability of an authenticity certificate from a third party.
The future inability of a third party to authenticate or certify the Product shall not, by itself, alter the agreed characteristics of the Product.
Article 22 — No Reliance on Third-Party Policies
The Customer acknowledges that authentication providers, resale platforms, marketplaces and other third parties may apply their own standards, procedures and commercial acceptance criteria.
These standards and policies are determined independently by such third parties and may change over time.
THDV has no control over third-party acceptance policies and cannot guarantee acceptance by any particular platform or service.
A refusal by any third party to authenticate, list, purchase or otherwise accept a Special Item shall not, by itself, affect the authenticity, conformity or description of the Product sold by THDV.
Article 23 — Liability
THDV shall perform its obligations with reasonable care and professional diligence.
THDV shall only be liable for direct damages resulting from an attributable failure to perform its obligations, except where mandatory law provides otherwise.
THDV shall not be liable for indirect damages, including loss of profits, loss of business opportunities, reputational damage or consequential damages, unless such exclusion is not permitted under applicable law.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.
Article 24 — Complaints
THDV aims to provide the highest level of customer service and care.
Complaints regarding Products, services or orders should be submitted in writing as soon as reasonably possible after discovery of the issue.
The Customer should provide a clear description of the complaint, relevant order information and supporting evidence where available.
THDV will review complaints carefully and respond within a reasonable timeframe.
Article 25 — Force Majeure
THDV shall not be liable for delays or failure to perform obligations caused by circumstances beyond its reasonable control.
Such circumstances may include failures of suppliers, carriers, payment providers, communication networks, governmental measures, natural events or other unforeseen circumstances.
If a force majeure situation continues for an extended period, THDV may take appropriate measures, including cancellation of the affected Agreement where reasonably necessary.
Article 26 — Intellectual Property
All content published by THDV, including photographs, texts, designs, logos, graphics and other materials, remains the intellectual property of THDV or its licensors.
The Customer may not reproduce, distribute, modify or commercially use THDV content without prior written permission.
Product images and descriptions may only be used for personal purposes relating to the Customer's purchase unless otherwise agreed.
Article 27 — Privacy
THDV processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
Personal data is processed only for legitimate business purposes, including order processing, customer service, payment processing and communication.
Further information regarding personal data processing can be found in THDV's Privacy Policy.
Article 28 — Governing Law & Disputes
These Terms & Conditions and all Agreements between THDV and the Customer are governed by the laws of the Netherlands.
Where mandatory consumer protection legislation provides otherwise, such mandatory rights shall remain applicable.
Parties shall first attempt to resolve disputes amicably before initiating formal proceedings.
Any disputes that cannot be resolved amicably shall be submitted to the competent court under applicable law.
Article 29 — Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain fully effective.
The invalid provision shall be replaced by a valid provision that reflects the original intention as closely as legally possible.
Article 30 — Entire Agreement & Final Provisions
These Terms & Conditions, together with the Product description, order confirmation and any additional agreements between THDV and the Customer, constitute the complete agreement regarding the purchase of Products.
THDV reserves the right to update these Terms & Conditions from time to time. The version applicable at the time of purchase shall govern the Agreement.
The latest version of these Terms & Conditions is always available on the THDV website.
